Terms and Conditions


General


The following terms and conditions (Terms) together with our privacy policy are the complete terms of a legal agreement between you and Sweet Chick Pty Ltd ABN 79 646 097 074 (“Sweet Chick”, “we”, “our” or “us”). Please read these Terms before accessing or using the website thesweetchick.com.au (“Site”) or making an order via alternative system (see below “how to make an order”). If you are under age 18 years of age, then you must obtain your parent or guardian’s consent before ordering.


Your agreement to these Terms


By accessing, using and placing an order for products you agree and are subject to and must comply with these Terms. Sweet Chick may vary these Terms occasionally by altering the version on the Site. You should visit the Site regularly to review any alterations. By using the Site, you accept the current Terms at the time you access and use the it.


Registration and use of your account


You must provide correct information in your account registration. If your information changes, prior to placing new orders, please update your details or contact us via email at [email protected]. You are responsible for the use of your account, including any other person who uses your account to order products through the Site. You agree to notify us if you become aware that your account has been compromised or used by unauthorised persons.


Placing an order


You may order products through the Site or by “Alternative ordering option” via email, on phone or in person at the store front. A three business day turn around period applies between placement of order and collection or delivery of goods.
Any order placed through the Site requires payment of the goods and any additional delivery fees, taxes or fees where applicable, as indicated at your order checkout. If you place an order via an Alternative ordering option, an invoice will be sent to you including the cost of products and any additional delivery fees, taxes or fees where applicable.
Orders will be considered processed once payment has been made and received. Your order may be accepted or rejected for any reason, including if we cannot fulfill the order for any reason or if there is an error in your order. If we reject an order, we will notify you and offer a refund or discuss alternative products to substitute your order.


Minimum order value


A minimum order value may apply to some orders on the site. If a minimum order applies, it will be displayed on the Site and will exclude delivery fees.


Price of goods


The price shown for each product on the Site is current price. The prices may change at any time and we do not need to provide notice of these changes. The final purchase price of products will be the price shown at time of order.


Specials


Sweet Chick may offer specials or deals throughout the year, which will only apply to your order if it is placed during the offer period. 


Modifying your order


Please contact the Sweet Chick team via email or phone to modify your order. We will endeavour to modify your order, but have no obligation to do so for any reason.


GST


Products offered for sale include GST where applicable included within the displayed price. A tax invoice will be issued to you when your purchase is complete.


Payment


You must choose a payment method on the Site when placing your order, or electronically transfer funds to a designated bank account if placing an order via an alternative ordering option.
If we have taken payment for any order that is rejected in part or whole, we will issue you a refund for the portion of order rejected.


Delivery


Sweet Chick will only deliver products to locations outlined on the Site. An additional delivery fee is applicable, which needs to be paid at the time of ordering. We will aim to deliver your order within the selected timeframe. However, times frames are not guaranteed and are an estimate only. You agree that someone will be present during the timeframe to receive the delivery.
If there is no one available at the delivery address to accept your order during the time period selected, we will attempt to call you for instruction. If the Delivery Service is unable to contact you, they may at its own discretion leave your product in a safe location and take a photo of the order as proof of delivery.
You agree that we nor the delivery service will be responsible for any loss, damage or theft of your order after the delivery has been made or left in a safe location either by instruction by your or discretion of delivery service.
If the delivery is unable to be made due to no one available to receive the order and no safe location to leave goods, your order will not be delivered. The delivery charge will be applied as a fee for failed delivery attempt. We will attempt to contact you to organise repeat delivery, where an additional delivery charge will be charged. You agree that we are not responsible for the decline of any perishable products, and that you will need to re-purchase products as delivery could not be made due to reasons beyond our control.


Pick-up


Free pick up is available from the store at 75 Fitzroy Street, Surry Hills, 2010, NSW. You will need to designate a pick up period during shop opening hours when placing the order.


Order Cancellation


Requests for order cancellations need to be made by phone, email or direct contact with our managers.
We are unable to cancel orders or issue refunds or store credits once production has started on your order.
For catering orders, a non-refundable deposit is applicable. If you wish to cancel a catering order where a non-refundable deposit has been paid, you can only do so if production has not started, and you will only be refunded for funds paid in addition to the non-refundable deposit.


Returns, refunds and complaints


If you are unsatisfied with an item, please call and email us immediately so that we have a record of problem. Please include a photo and description of your complaint. We will then determine if complaint is eligible for a refund, replacement of product or no action. As our products are perishable, we do not accept returns. 

 

Dietary Information


All products are Kosher under The Kashrut Authority of Australia. KA (only) is parev, whereas KA(D) is dairy.
Our products are made in a kitchen that may contain traces of eggs, soy, nuts and gluten, and therefore, may contain traces of these allergens. Gluten-free options are not to be considered coeliac, due to potential traces of allergens.

Sweet Chick is committed to precautionary measures for the safety of our staff and customers. We have a Covid Safety Plan, continuously monitor the covid situation and adjust processes as we determine necessary or as directed by the Department of Health.
